Terms and Conditions

1. OBJECT OF THE CONTRACT

Innosolution GmbH develops and manufactures high-quality massage, vibration, and shock wave devices for therapeutic muscle massage. They are offered and distributed through this e-shop “shop.prolaxsys.com” under the protected proprietary brand “PROLAXsys”.

2. PAYMENT TERMS / ADVANCE PAYMENT / IN-STORE PURCHASE

For purchases made in person at the Siebnen location, payment is made in cash as it is an in-store sale. However, for shipped goods, advance payment is required, which is referred to as prepayment. In both cases, we also offer the option of cashless payment through various credit cards, including Visa, V PAY, Mastercard, Maestro, American Express, Discover, Diners Club, and Union Pay. A credit card terminal is available in the store to process payments on-site. Alternatively, upon request, we can provide a payment link via email for online payment. Our bank details for direct bank transfer are as follows:

Bank or credit card fees are the responsibility of the buyer and will be invoiced if necessary.

3. ORDER PROCESSING

The execution of an order takes place upon receipt of the advance payment. Please note that the advance payment must be made within 7 days to ensure order processing. We want to emphasize that no steps towards order fulfillment will be taken before receipt of the advance payment. If the advance payment is not made on time, we reserve the right to cancel the order without further obligations.

4. VALUE ADDED TAX AND CUSTOMS FEES

All prices of our products are exclusive of statutory value-added tax. Therefore, the purchase price will be higher at the end.
For shipping or sales in Switzerland and Liechtenstein, a Swiss value-added tax of 7.7% is added to the purchase and shipping price. This will be indicated on the invoice.
For shipping abroad, additional country-specific value-added taxes apply. These must be paid directly to the local customs office or delivery service before the goods are delivered. The cost for creating customs documents is about CHF 20, and customs clearance is charged at about 3% of the value of the goods. These costs are not listed on our invoice.
As an example, for an order to Germany with a product and shipping value of CHF 1000, the additional fees would be: CHF 20 for customs papers, CHF 190 for German value-added tax (19% of the product value), and CHF 30 for customs clearance fees (3% of the product value). These total costs of CHF 240 will be collected by the local post office or courier service before the goods are delivered. Therefore, the total end price for the product is approximately CHF 1240.

5. SHIPPING, TRANSPORT INSURANCE, AND PROCEDURE FOR TRANSPORT DAMAGES

We exclusively use Swiss Post Priority for worldwide shipping. For express deliveries, we collaborate with Swiss Post Urgent. Shipping costs depend on weight, destination country, delivery time, and packaging. The goods are insured against transport damages and loss.
In the case of visible transport damage, you must report this within three working days. Damages need to be documented. Provide us with photos of the external packaging and the damaged contents.

6. DELIVERY TIME

The delivery time depends on the chosen shipping method (Priority or Express) and the duration of customs processing in the importing country. Usually, shipping from the factory starts a few weeks after receipt of the advance payment.

7. WARRANTY AND RETURNS IN CASE OF WARRANTY

For commercial use, the warranty is 1 year, and for private use, it is 2 years. The postmark serves as proof in case of warranty claims.
The claim to warranty coverage expires prematurely in case of self-repair or damage due to improper handling. In the event of warranty processing, the customer bears the incurred shipping costs.
Prior to returning, contacting our customer service is necessary to receive further instructions.
Returns are at the customer’s expense and risk. Please ensure that the products are securely and appropriately packaged to avoid damage during return transportation.

8. DISCLAIMER REGARDING MEDICAL USE OF OUR MASSAGE DEVICES

We explicitly state that our products are not designed as medical devices and do not serve medical purposes. They are products developed to promote relaxation and well-being.
Our massage devices are not intended to diagnose, treat, cure, or prevent diseases. Any statements made on our website or in our marketing material regarding medical effects or results are purely informational and should not be considered a substitute for professional medical advice or treatment.
We strongly recommend that individuals with medical concerns or health issues consult qualified medical professionals before using our massage devices. Any decisions regarding the use of our massage devices are solely the responsibility of the user.
Our products are designed to promote relaxation and well-being, and we assume no liability for any damages, injuries, or negative effects that could result from the use of our massage devices.
By using our massage devices, you expressly agree to these terms of use and acknowledge that our products must not be used for medical purposes.

9. WITHDRAWAL OR EXCHANGE RIGHT FOR ONLINE PURCHASES

Neither individuals nor business owners have the right to withdraw or exchange.

10. REFUND

In adherence to the general exemption rule, the buyer has no right to return or revoke. Nonetheless, it is possible to request a refund, where the purchase price is reimbursed. Shipping fees, bank charges, and other fees are excluded from this refund. To request a refund, the customer must submit a written application and explain the reasons for the request. The provider will thoroughly review the request and decide whether to grant the refund. Please note that the processing of refund requests may take some time due to careful examination.

11. JURISDICTION

This contractual relationship is subject to Swiss law. The place of jurisdiction is at the headquarters of Innosolution.
